    • Most of us probably feel like we know what working ethically is and probably think we would behave ethically no matter the situation. However, ethics in a professional environment presents a new set of ethical scenarios for you to consider and it is important you know where your values lie before you commence your real estate career. Adhering to ethics standards are built into the licence requirements of many states and territories for this reason. In this module, we look at what ethics is, what the ethical issues are in real estate and the things you need to be aware of as you become a practicing real estate agent.

      By the end of this module, you will understand:

      ➤ What we mean when we talk about ethics in real estate
      ➤ Codes of ethics in real estate
      ➤ The relevant industry Codes of Conduct 
      ➤ Duty of care
      ➤ Consumer protection requirements

    • Legislation can be overwhelming. However, by knowing a few fundamental rules to interpretation and by knowing where to look when you need advice, knowing how legislation is structured and what to do if there are conflicts between legislation, you will be set up for success since dealing with legislative frameworks is an important component of your role in real estate.

      By the end of this module, you will understand:

      ➤ The difference between Acts and subsidiary legislation like regulations and by-laws 
      ➤ How legislation is created
      ➤ What equity law is
      ➤ Relationships between different pieces of legislation
      ➤ Some rules on interpreting legislation
      ➤ Structure of legislation

     For this assessment task, you will identify and read the guidance material relating to the issue of stigmatised properties in real estate. Your task is to use the guidance material provided by your trainer to help you interpret the legislation which relates to this issue for estate agents and clients.

    Legislation Report

    Report


     Students will access and analyse two pieces of current legislation related to real estate practice in their state or territory. The legislation can be related to their own state or territory or can be federal legislation. Students must complete all parts of the report for each piece of legislation.

    Ethics Report

     Report


     Students will access a published real estate industry prosecution where consumer protection requirements were breached. They should develop a report based on this prosecution using the headings included.
